Terms of Service
Effective Date: March 20, 2026These Terms of Service ("Terms") constitute a legally binding agreement between you and Project Black Men, LLC ("Project Black Men," "we," "us," or "our") governing your access to and use of the ARISE platform ("Platform"). By accessing or using the Platform, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, do not access or use the Platform.
1. Description of Service
ARISE is a developmental support platform for young men ages 10–24 and their parents or legal guardians ("Parents"). The Platform provides weekly structured check-ins, AI-assisted developmental insights, parent observation tools, and facilitator dashboards. ARISE is operated as part of the Project Black Men's community programming.
2. Limitation of Purpose — Not a Clinical Service
ARISE IS NOT A MEDICAL, THERAPEUTIC, PSYCHOLOGICAL, OR CLINICAL SERVICE. The developmental insights generated by the Platform are informational observations derived from self-reported data and AI analysis. They do not constitute diagnoses, treatment recommendations, prescriptions, or professional advice of any kind. The Platform is not a substitute for professional counseling, therapy, psychiatric care, or emergency services.
If a Participant is experiencing a mental health crisis, call 911, contact the 988 Suicide & Crisis Lifeline (call or text 988), or text HOME to 741741 (Crisis Text Line).
3. Eligibility
You must be at least eighteen (18) years of age and the legal parent or guardian of the enrolled Participant to create an account. Youth participants ("Participants") between the ages of 10 and 24 access the Platform through secure, single-use links provided by their Parent; Participants do not create accounts or provide credentials.
By enrolling a Participant in ARISE, you represent and warrant that: (a) you are the Participant's parent or legal guardian; (b) you have the legal authority to consent to the collection of the Participant's information as described in the Privacy Policy; and (c) all information you provide is accurate and complete.
4. Parental Consent Requirement
Prior to any data collection from a Participant, the Parent must complete the Platform's electronic parental consent flow. This consent encompasses: (a) the collection of check-in responses and behavioral data from the Participant; (b) the transmission of such data to a third-party AI provider (Anthropic, PBC) for processing; (c) the Platform's safety monitoring and mandatory escalation protocol; and (d) the storage and longitudinal analysis of Participant data for developmental tracking purposes. Consent may be revoked at any time as described in the Privacy Policy.
5. Artificial Intelligence Disclosure
The Platform employs artificial intelligence ("AI") provided by Anthropic, PBC to analyze Participant check-in data and generate developmental insights. By using the Platform, you acknowledge and agree that: (a) Participant check-in responses, behavioral metadata, and historical patterns are transmitted to Anthropic's servers for inference processing; (b) the AI does not make autonomous decisions regarding the Participant's care or treatment; (c) AI-generated outputs may contain inaccuracies, and you should not rely on them as the sole basis for decisions affecting the Participant; and (d) we apply data minimization practices, transmitting only first names and check-in data — not email addresses, last names, or location information.
6. Safety Protocol and Mandatory Escalation
The Platform includes automated safety monitoring that cannot be disabled. If a Participant's responses indicate potential self-harm, suicidal ideation, or disclosure of abuse, the Platform will: (a) immediately display crisis intervention resources; (b) create an immutable safety record; and (c) notify Facilitators and program staff for follow-up intervention.
You acknowledge and agree that this safety protocol takes priority over privacy preferences. We may, in our sole discretion, take additional steps we deem necessary to protect the safety of a Participant, including contacting emergency services. Additionally, depending on applicable state law, Project Black Men and its staff may be required to report certain disclosures — including disclosures of child abuse, neglect, or imminent threat of harm — to child protective services, law enforcement, or other governmental authorities, regardless of the preferences of the Parent or Participant.
7. Parent Obligations
As a condition of using the Platform, you agree to: (a) provide accurate, current, and complete information during registration and ongoing use; (b) maintain the confidentiality of your account credentials; (c) share the Participant's check-in link only with the intended Participant and not with third parties; (d) respect the privacy of other families enrolled in the program; (e) promptly notify us of any unauthorized access to your account or your child's check-in link; and (f) notify us if you wish to withdraw from the program or if the Participant's enrollment information changes.
8. Intellectual Property
The Platform, including its design, code, ARISE Youth Development Framework (AYDF), question architecture, scoring methodology, and all associated intellectual property, is owned by Project Black Men, LLC and protected by applicable copyright, trademark, and other intellectual property laws. Your use of the Platform does not grant you any ownership interest in the Platform or its intellectual property. You retain all rights in the data you and your child submit to the Platform.
9. Data Rights
You retain all rights in your child's data. You may export, review, or permanently delete your child's data at any time through the parent dashboard, as described in the Privacy Policy. We do not claim any ownership interest in Participant data. We do not sell, rent, license, or otherwise disclose Participant data for advertising or marketing purposes.
10. Prohibited Conduct
You agree not to: (a) use the Platform for any purpose other than youth developmental support as contemplated by these Terms; (b) attempt to access, modify, or delete any data belonging to other users; (c) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform; (d) use automated scripts, bots, or scrapers to interact with the Platform; (e) submit false, misleading, or fabricated information; (f) circumvent or disable any security features of the Platform; or (g) use the Platform in any manner that could damage, disable, or impair the Platform or interfere with any other party's use.
11. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PROJECT BLACK MEN DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED OUTPUTS WILL BE ACCURATE, COMPLETE, OR APPROPRIATE FOR ANY PARTICULAR PURPOSE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROJECT BLACK MEN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
13. Indemnification
You agree to indemnify, defend, and hold harmless Project Black Men and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your breach of these Terms; (b) your violation of applicable law; or (c) your negligent or wrongful conduct in connection with the Platform.
14. Termination
You may discontinue use of the Platform at any time by deleting your child's data and deactivating your account through the dashboard. We may suspend or terminate your access to the Platform at any time, with or without cause, upon notice to your registered email address. In the event of termination by us without cause, we will provide you with at least fourteen (14) days' notice and an opportunity to export your child's data before deletion.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State in which Project Black Men is incorporated, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Platform shall first be submitted to good-faith mediation. If mediation is unsuccessful, the dispute may be submitted to binding arbitration under the rules of the American Arbitration Association, or either party may file suit in a court of competent jurisdiction.
16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
17. Entire Agreement
These Terms, together with the Privacy Policy and any consent forms executed through the Platform, constitute the entire agreement between you and Project Black Men regarding the Platform and supersede all prior agreements, understandings, and representations.
18. Amendments
We reserve the right to amend these Terms at any time. Material amendments will be communicated to you via email at least thirty (30) days before the effective date. Your continued use of the Platform following the effective date of any amendment constitutes your acceptance of the revised Terms.
